Terms and conditions of digital forums where WelTec is deemed to be a Host
1.1. Please read these Terms and Conditions carefully. Including the Privacy Statement, they govern our relationship with you regarding the use of digital forums where WelTec is deemed to be a host.
1.2. These Terms and Conditions may change from time to time. Users will be made aware of the changes through notifications on the forum. Continued use of the forum indicates your on-going acceptance of these Terms and Conditions, including any changes to them.
2.1. A WelTec Digital Forum is defined as an online environment that facilitates the exchange of information between people and where an employee of WelTec has administration rights and is recognised as the Host.
3. Purpose of digital forums
3.1. WelTec Digital Forums are for engagement with and between tertiary students and stakeholders on matters and in such a way that supports a positive student experience.
4.1. Unless stated otherwise, WelTec does not endorse any opinion, statement or other content posted on, or accessible through, WelTec Digital Forums other than that expressed by WelTec employees acting as an agent of WelTec and governed by the WelTec Code of Professional Practice.
4.2. WelTec disclaims and excludes all liability for any claim, loss, demand or damages of any kind whatsoever arising out of or in connection with the use of WelTec Digital Forums or the information, content or materials included on WelTec Digital Forums or service to which they are linked.
5. Governing law
5.1. These terms and conditions shall be construed and applied in accordance with the laws of New Zealand, including the Harmful Digital Communications Act 2015, and users consent to the exclusive jurisdiction of the New Zealand Courts to determine any matter or dispute that arises under these Terms and Conditions in accordance with the laws of New Zealand. Where a web-platform, such as Facebook, has their own terms and conditions they are to be applied with respect to New Zealand law.
6. Code of conduct
6.1. Users of WelTec Digital Forums will commit to using the digital forum for educational, personal and professional, and non-commercial purposes to enhance experience of tertiary students.
Users are expected to observe the following guidelines:
6.1.1. Be courteous and respect other users’ viewpoints.
6.1.2. Do not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
6.1.3. Do not post or upload any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
6.1.4. Do not conduct or forward surveys, contests, pyramid schemes or chain letters.
6.1.5. Do not restrict or inhibit any other user from using and enjoying the digital forum services.
6.1.6. Do not collect information about others, including e-mail addresses, without their consent.

8. WelTec’s rights and responsibilities
8.1. WelTec is not responsible for screening, monitoring or verifying student-generated content of the material posted in WelTec Digital Forums, including content accuracy, reliability or compliance with copyright or other laws. However, WelTec may from time to time monitor or review postings.
8.2. WelTec reserves the right to remove or edit content that is deemed inappropriate, offensive, irrelevant to the site, of a commercial nature or otherwise is deemed to be in breach of the Terms and Conditions of Digital Forums.
8.3. Under no circumstances will WelTec sell, rent or give forum users private information including name, address, and email to third parties.
8.4. Complaints are governed by the WelTec Digital Forum user advisory, which explains the conditions for a complaint and the process to follow to lodge a complaint.
8.5. WelTec will:
8.5.1. Do its utmost to protect the privacy of the users of WelTec Digital Forums in accordance with the Privacy Statement.
8.5.2. Respond to feedback or questions about the forum.
8.5.3. Make accessible advice regarding user rights and processes for making complaints under the governing law.
8.5.4. Provide a means by which users may choose to unsubscribe from a WelTec Digital Forum.
9. Digital Forum feedback
9.1. WelTec welcomes feedback. Please forward comments or feedback to the digital forum administrator (the Host) in the first instance.
10. Privacy Statement
10.1. WelTec will take all reasonable steps to ensure personal information held is not subject to loss, misuse, unauthorised access, disclosure or alteration.
10.2. Any unsolicited contact WelTec Digital Forum users receive as a result of personal information they have publicly released is their responsibility.

11.1. Material submitted to WelTec Digital Forums is, by default, done so under the Creative Commons 3.0 Attribution – Non-commercial – Share-alike New Zealand license.
